It is a standard administrative requirement under Spanish law and, when managed correctly, it does not represent a major obstacle. Spanish military authorisation originates from a law introduced in 1975 relating to areas or installations considered of strategic interest for national defence. In municipalities classified as “restricted areas for foreigners”, non-EU nationals must obtain approval from the Ministry of Defence before purchasing certain types of rural property.
Although the regulation dates back decades, it remains in force and continues to apply in various locations across Spain, including parts of the Balearic Islands where many buyers search for country residences and rural estates.

Military authorisation is generally required when the property is located on rural land (suelo rústico), situated in a municipality classified as restricted under Spanish defence regulations, and being purchased by a non-EU national (EU citizens are generally exempt). This situation commonly applies to countryside homes, agricultural land, vineyards and fincas for sale in Pollença and surrounding rural areas.
Important: This requirement usually does not apply to urban properties. Apartments, townhouses, villas and plots on urban land can generally be purchased without military authorisation, regardless of nationality.
Another key point is that the authorisation is property-specific — it is only applied for once a particular property has been selected.
In practice, the application is usually submitted after an offer has been accepted and the private purchase contract has been signed.
The private contract is made conditional to the favourable resolution of the military authorisation, which fully protects the buyer. This is a normal approach and allows the transaction to progress correctly while safeguarding your position.
Because approval can take up to four months, we always recommend planning early and timing the application carefully, particularly when purchasing rural properties.
If the property is on rural land and falls within a restricted area, buyers will generally be asked for a full copy of their passport, a NIE (Spanish tax identification) number, and a Police Certificate or Certificate of No Criminal Record (ACRO for UK buyers). It is important to note that police certificates have a limited period of validity. For this reason, we advise against requesting them too early and help our clients plan the timeline carefully to avoid unnecessary renewals.
A NIE is essential — not only for military authorisation, but also for signing the title deeds at the notary, paying taxes linked to the purchase, and applying for a Spanish mortgage.
Unlike military authorisation, a NIE is not linked to a specific property, meaning it can be requested at the very start of your property search.
For UK buyers in particular, we strongly recommend starting the NIE application via the Spanish Consulate in London as early as possible, as processing times can vary.
